4.2 ENFORCEMENT AND REMEDIES

You acknowledge and agree that Lighthouse Academy shall have no obligation to refund any fees paid, issue course certification, or grant future access to the Services in the event of your breach of this Section 4.
- ELIGIBILITY TO USE OUR SERVICES

- PLATFORM ACCESS AND USE LIMITATIONS
7.1 PERSONAL USE
All rights of access granted under these Terms, including but not limited to login credentials, live or recorded content, course materials, and participation in student communities or forums, are strictly personal to the individual student to whom they are issued. Such access may not, under any circumstances, be sold, shared, assigned, sublicensed, transferred, or otherwise conveyed to any third party without the prior written consent of Lighthouse Academy.
Any attempt to transfer or share access rights without authorization shall constitute a material breach of these Terms and may result in immediate suspension or permanent revocation of access to the Services, without notice or refund.
7.2 TECHNICAL ACCESS REQUIREMENTS
Students are solely responsible for maintaining the necessary technical infrastructure to access and engage with the Services, including reliable internet connectivity, compatible hardware and software, and up-to-date browsers. Lighthouse Academy disclaims all liability for access limitations arising from hardware failures, insufficient bandwidth, incompatibility with third-party platforms, or local technical restrictions.
Lighthouse Academy will make commercially reasonable efforts to deliver Services as scheduled and to facilitate access to instructional sessions, community platforms (e.g., Discord), and downloadable resources. However, access is expressly subject to ongoing compliance with these Terms and may be suspended or revoked without notice in the event of noncompliance.
7.3 PLATFORM FUNCTIONALITY
While Lighthouse Academy endeavors to provide uninterrupted and high-quality access to its Services, you acknowledge that occasional delays, downtimes, or disruptions may occur due to planned maintenance, system upgrades, technical failures, or external events. Accordingly, Lighthouse Academy reserves the right, at its sole discretion and without prior notice, to:
- Modify, suspend, restrict, or discontinue any component of the Services;
- Perform updates, patches, or infrastructure maintenance as needed;
- Limit access in response to legal, regulatory, commercial, or jurisdictional constraints.
Lighthouse Academy shall not be liable for any temporary or permanent interruptions in Service availability, provided that reasonable efforts are made to resume access within a commercially practicable timeframe.
Where changes to a Course are initiated by Lighthouse Academy and materially alter your ability to complete the Course as originally outlined, the Academy will bear any associated costs. Conversely, if you request or initiate changes to your enrollment or participation, all resulting costs shall be your sole responsibility.
7.4 CONTENT AVAILABILITY
All instructional materials provided by Lighthouse Academy, including but not limited to video recordings, templates, worksheets, documentation, workflows, and other digital assets (“Course Content”), are offered strictly as limited-term educational resources.
Unless otherwise expressly stated in writing, you acknowledge and agree that:
- Course Content is made available online only for the duration of your designated access period, typically six (6) months following course completion;
- Access to such Content is not permanent and does not entitle you to ongoing, indefinite, or lifetime online use;
- You are solely responsible for engaging with, utilizing, and, where expressly permitted, downloading any materials you wish to retain within the stated availability period.
Lighthouse Academy retains full and exclusive rights to modify, update, restrict, archive, or permanently remove any portion of Course Content at its sole discretion and without prior notice. Such changes may be made for legal, operational, technological, or pedagogical reasons. You expressly acknowledge that:
- The presence of Course Content during your enrollment does not guarantee its future availability;
- The Academy is under no obligation to maintain any specific content, module, or resource beyond the defined access window;
- Continued access to any materials following the conclusion of your Course is extended as a discretionary courtesy, not as a contractual entitlement.
In the event that Lighthouse Academy initiates substantive changes to the format, schedule, delivery method, or structure of any Course that materially affects your ability to participate or complete the Course as originally described, we will bear the associated costs. However, where changes are requested or initiated by you, all related costs and liabilities shall be borne solely by you.
Lighthouse Academy disclaims all liability for any loss of access to Course Content beyond the scheduled availability period. You waive any claim to compensation, reimbursement, or damages relating to the unavailability, removal, or alteration of any Course Content beyond the access term.
You are strongly encouraged to complete your coursework and download any permitted materials within the designated time frame.
- FORCE MAJEURE (EVENTS BEYOND OUR CONTROL)
Lighthouse Academy shall not be held responsible or liable for any failure or delay in the performance of its obligations under these Terms, including delivery of any Course or Service, where such failure or delay is due to causes beyond its reasonable control (“Force Majeure Events”).
Force Majeure Events include, but are not limited to: acts of God; natural disasters; fire; flood; earthquake; pandemics or epidemics (including related government regulations or shutdowns); war; terrorism; armed conflict; civil unrest; labor strikes or disruptions; embargoes; export restrictions; utility failures; internet or telecommunications outages; platform outages; denial-of-service attacks; or the failure of any third-party service provider, hosting partner, or technology platform. In such cases:
- Lighthouse Academy’s obligations shall be suspended for the duration of the Force Majeure Event and a reasonable recovery period thereafter;
- We will make commercially reasonable efforts to mitigate the disruption and resume Services as promptly as practicable;
- If, in our sole discretion, continued delivery of the affected Course or Service is rendered impracticable, we reserve the right to cancel such portion of the Course or Service by written notice, without liability for compensation, refund, or damages.
You expressly agree that the occurrence of a Force Majeure Event does not entitle you to cancel your enrollment, seek a refund, or assert any claim for damages, provided Lighthouse Academy has exercised reasonable efforts to respond to the disruption.

- Lighthouse Academy makes no representation, promise, or warranty that your participation in any Course or Courses will be recognized by employers, educational institutions, licensing bodies, or other third parties for any specific purpose.
You are solely responsible for determining whether your participation in any Course offered through the Services will meet your personal, academic, or professional goals, including whether it satisfies any applicable continuing education, regulatory, or licensure requirements. Lighthouse Academy expressly disclaims any and all liability for any misunderstanding, reliance, or assumption regarding the recognition, acceptance, or utility of any Course or credential in any academic, employment, or licensing context.
Furthermore, you acknowledge and agree that participation in any Course or Courses does not constitute a guarantee, promise, or assurance of employment, job placement, business development, client acquisition, revenue generation, or any form of economic benefit. While the Courses are designed to enhance your knowledge and skills, your individual success will depend on a variety of factors outside of Lighthouse Academy’s control, including your effort, experience, initiative, and prevailing market conditions.
Lighthouse Academy shall not be held liable for any loss, disappointment, or opportunity cost incurred as a result of your reliance on the Courses for professional, commercial, or academic advancement.
- INTELLECTUAL PROPERTY
All course content, including but not limited to materials, recordings, templates, instructional videos, branding, software, and documentation ("Academy Content"), is the intellectual property of Lighthouse Academy or its licensors.

Lighthouse Academy shall not be liable for any damages, losses, or breaches arising from your use of or reliance on third-party tools, platforms, or content.
